Terms of Service

1. Parties

These Terms of Service ("Terms") are between Talentpros Consulting Pvt Ltd, a company incorporated in India ("RecruitEasy", "we", "us", "our"), and you, the individual or entity accessing or using the RecruitEasy platform ("you", "User").

2. Your Account

• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account
• You must be at least 18 years old and legally authorised to enter into contracts under Indian law
• You must provide accurate and complete registration information and keep it updated
• One account per individual; Agency plans support multiple named seats under one billing account
• Sharing your account credentials with non-seat holders is not permitted on Individual plans

3. Acceptable Use

You may use RecruitEasy only for lawful recruitment and talent management purposes. You may not:

• Store or process candidate personal data without obtaining their consent as required under the DPDP Act 2023 (this obligation is yours as the Data Fiduciary)
• Scrape, clone, frame, reverse-engineer, or decompile any part of the platform
• Resell, sublicence, or white-label access to the platform without a written agreement with us
• Build a competing product or service using our infrastructure, APIs, or AI outputs
• Send spam, unsolicited bulk communications, or harassing messages to candidates through the platform
• Upload content that is illegal, defamatory, discriminatory, or violates the rights of any third party
• Attempt to gain unauthorised access to other users' accounts or data

We reserve the right to suspend or terminate accounts that violate these rules without notice.

4. Plans, Billing & Cancellation

• Paid plans (Individual, Agency) are billed monthly or annually, in advance, via Razorpay
• All prices shown are exclusive of GST. GST at the applicable rate will be added at checkout
• GST-compliant invoices are generated automatically and downloadable from your dashboard under Billing
• You can cancel at any time; access continues until the end of your current paid billing period
• We do not offer refunds for partial billing periods, except where required by applicable law
• We reserve the right to change pricing with 30 days' notice; you may cancel before the change takes effect
• Failed payments result in a 7-day grace period before the account is downgraded to Free

5. Free Plan & Trial

The Free plan is provided as-is, without any service level commitments. The 14-day free trial of paid features is available once per account. We reserve the right to modify or discontinue the Free plan with 30 days' notice.

6. AI Features

AI outputs produced by RecruitEasy — including résumé scores, candidate rankings, email drafts, and JD analysis — are suggestions generated by AI models and are not professional advice. They are provided to assist your workflow, not to replace your professional judgement.

• RecruitEasy is not liable for any hiring decisions, rejected candidates, or missed placements arising from reliance on AI-generated content
• You remain solely responsible for all candidate assessments, hiring decisions, and communications with clients
• AI outputs may contain errors or biases; always review before sending to clients or candidates

7. Google Integration

If you connect your Google account, you authorise RecruitEasy to act on your behalf for the specific scopes you approve (Gmail send, Calendar, Drive). You can revoke this access at any time. Our handling of Google user data is governed by our Privacy Policy and the Google API Services User Data Policy.

8. Data Ownership & Export

You own all data you upload to RecruitEasy — candidate records, job descriptions, notes, and documents. We process it solely to provide the service to you.

• You can export all your data at any time from Settings → Export
• On cancellation, your data remains accessible for 30 days for export
• After 30 days from cancellation, all your data is permanently deleted from our systems
• We do not claim any ownership, licence, or right to use your data beyond delivering the service

9. Intellectual Property

RecruitEasy and all related software, designs, trademarks, and content are owned by Talentpros Consulting Pvt Ltd. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the platform. No other rights are granted.

10. Availability & Service Levels

We target 99.5% monthly uptime. We perform maintenance during low-traffic windows (typically 2–4 AM IST on weekdays) and will notify you in advance for planned downtime exceeding 30 minutes. We are not liable for downtime caused by third-party providers (cloud infrastructure, payment processors, AI APIs).

11. Limitation of Liability

To the maximum extent permitted by law, RecruitEasy's total liability to you for any claim arising under or relating to these Terms is limited to the total fees you paid us in the 3 months immediately preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost placements, lost revenue, or reputational harm, even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless Talentpros Consulting Pvt Ltd, its directors, employees, and contractors from any claims, damages, or expenses arising from your use of the platform, your violation of these Terms, or your violation of any applicable law including the DPDP Act 2023.

13. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

Before initiating legal proceedings, both parties agree to attempt good-faith resolution by contacting partner@talentpros.in.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you by email and display a notice in the app at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
